BARNSTABLE — The District Attorney for Cape Cod and the Islands has admitted that person who crashed into the SUV driven by the new father in Mashpee over the weekend, should not have been free.

D.A. Michael O'keefe said that Mickey Rivera of Fall River was arrested in Hyannis in June, but that a mistake let him go free. O'Keefe told The Boston Globe that at the time Rivera was arraigned, the assistant prosecutor was new at the job and did not have many details about Rivera's previous arrests. He was then released without bail.

Rivera was indicted in Fall River is 2015 in connection with the fatal shooting of Anthony Carvalho. He was then held on $35,000 bail until a Supreme Court ruling reduced that bail to $1,000 last year. Bail was posted and Rivera had been free ever since.

Early on Saturday, Rivera was seen driving erratically in Mashpee. While being chased by police, he crashed head-on into the SUV driven by Quinn. Quinn was a Marine veteran who was returning home from visiting his wife and newborn daughter at the hospital. Both Quinn and Rivera were killed. A passenger in Rivera's car, Jocelyn Goyette of New Bedford, died Monday from her injuries.
