Walmart has agreed to pay 10 million dollars in a settlement to the family of James McNair, who was killed in an accident on the New Jersey Turnpike last summer, involving a Walmart tractor trailer.

The accident is the same one that seriously injured comedian Tracy Morgan.  Morgan and McNair were on their way back from a comedy show in Delaware, when the accident occurred. The driver of the Walmart truck, Kevin Roper, had reportedly been awake for more than 24 hours when the accident happened.

According to the Associated Press, James McNair's children, 26-year-old Jamel and 19-year-old Denita, will put aside part of the settlement for increasing monthly payments, which will start at $3,000 and will continue for the rest of their lives.

The lawsuit was apparently settled earlier this year, but information regarding the amount of the lawsuit, was just released last Friday.

There's a separate lawsuit that Tracy Morgan has against Walmart, and word has it, the driver of the Walmart truck, Kevin Roper, has repeatedly attempted to delay the case.  His argument is that as more details from the case emerge, that could adversely affect him in a criminal case that he's facing.
