Tom Brady is open to accepting some form of suspension, but only if he fails to cooperate with the NFL rather than admitting to the findings of the Wells report.

According to ESPN, league sources said in a settlement that discussions on Brady’s attempt to overturn his four-game suspension have gone “nowhere.”

Brady, who had planned to attend Wednesday’s federal court hearing in New York, will instead join the Patriots for their joint practices with the New Orleans Saints in West Virginia.

U.S. District Court Judge Richard M. Berman instructed Brady, the NFL and the players' union to attempt to reach a settlement in the case. Last Wednesday, both Brady and Goodell appeared in court with little progress being made.

On Friday, Brady's attorneys filed documents in the U.S. District Court, claiming a smear campaign against the two-time NFL MVP over unfair treatment by Goodell and the league.

Brady is pushing to overturn the suspension for his role in the use of deflated footballs in the AFC Championship Game versus the Colts. The suspension was upheld on July 29 when Brady appealed, allowing Brady to file suit in federal court.
