The NFL isn't giving up its "deflategate" fight.

U.S. District Court Judge Richard M. Berman has announced that Monday's final attempt at a settlement agreement between New England Patriots quarterback Tom Brady and the NFL has failed to succeed, according to ESPN.

Tom Brady is open to accepting some form of suspension, but only if he fails to cooperate with the NFL rather than admitting to the findings of the Wells report.

After reports surfaced earlier in the day that he would be in attendance for this Wednesday's appeal hearing of his Deflategate suspension, it seems that New England Patriots Quarterback Tom Brady has had second thoughts.
